It would be illegal for him to record the phone calls, but keeping records is fine.

I am not a lawyer, and this is not legal advice:

It depends on the state/combination of states. Federal law and the laws of thirty-eight states and the District of Columbia permit individuals to record conversations to which they are a party without informing the other parties that they are doing so. However, there are twelve exception states, where all parties must consent to recording: California, Connecticut, Florida, Illinois, Maryland, Massachusetts, Michigan, Montana, Nevada, New Hampshire, Pennsylvania and Washington.
